Salstead Worker Agreement (Contract of Employment)
This is the template Salstead issues to every worker joining the staff bank. Each worker is presented with a personalised copy when they accept their first shift, which becomes binding on both parties.
1. Parties and effective date
Between Salstead Ltd and [WORKER NAME], taking effect on [START DATE].
2. Employment status
PAYE employee of Salstead. Not self-employed, not an umbrella worker. Statutory rights apply.
3. Role and place of work
Role: [ROLE]. Reporting to Salstead Ltd and the Person in Charge at the assigned care home. Place of work: assignments within reasonable travel distance.
4. Working hours
Flexible hours; no guaranteed minimum. Working Time Regulations 1998 apply. 48-hour weekly limit unless opted out in writing.
5. Pay
£[RATE] per hour. Enhancements for nights, weekends and bank holidays. At or above the National Living Wage. Paid weekly by BACS within 7 days of timesheet approval. Electronic payslips via Salstead.
6. Holiday entitlement
5.6 weeks per year (pro rata), at 12.07% of hours worked. Method: [accrued or rolled-up, per applicable case law].
7. Pension
Auto-enrolment under the Pensions Act 2008 into NEST. Employee 5%, Employer 3% of qualifying earnings.
8. Sickness and statutory leave
SSP per statute. Fit note required after 7 days. Statutory parental and bereavement leave apply.
9. Conduct and standards
- Comply with the Salstead Acceptable Use Policy, Code of Conduct and Safeguarding Policy.
- Maintain professional registration where required.
- Hold a current enhanced DBS check and notify changes immediately.
- Hold UK right to work; provide evidence on request.
- Complete mandatory training on time.
- Treat all colleagues, residents and family members with dignity and respect.
10. Confidentiality and data protection
Strict confidentiality; compliance with UK GDPR, DPA 2018 and the Salstead Information Security Policy.
11. Equipment
Worker uses the Salstead mobile app. Smartphone with internet required. PPE supplied by the assigned care home.
12. Termination
1 week notice in the first 2 years; otherwise per s.86 Employment Rights Act 1996. Summary dismissal for gross misconduct.
13. Disciplinary and grievance procedures
Non-contractual; available in the Salstead platform. Compliant with the Acas Code of Practice.
14. Variation
Salstead may vary non-essential terms on reasonable notice. Essential terms (pay, hours, role) only by mutual consent.
15. Governing law
Laws of England and Wales; exclusive jurisdiction of the courts of England and Wales.
